STUDY PERMIT

International students may obtain temporary status after being issued study permits as members of student class.

A study permit is “a written authorization to engage in academic, professional, vocational, or other education or training in Canada that is issued by an office to a foreign national.”

How long can you stay in Canada with a study permit?

A study permit is usually valid for the length of your study program, plus an extra 90 days. This extra time lets you prepare to leave Canada or apply to extend your stay.

If you can’t finish your courses before the date on your permit, you must apply to extend your stay as a student.

If you finish your studies early, your permit will stop being valid 90 days after you complete your studies (no matter what day is printed on the study permit).

You have completed your studies either:

  • on the date you get the first notification from your school (such as an email, letter, transcript, etc.) or
  • when you get your degree, diploma or certificate.

You must prove provide proof of the date you got one of these.

Note: If you can’t prove the date you were first notified by your school, we will use the earliest issue date on the document. We may need to confirm this date with your school.

If you go out of Canada, you may need to show proof you are enrolled in your school when you return to Canada.

If you come on a visa, make sure it must be valid.

To be eligible to apply for a study permit, your course or program must be from a DLI. If you decide to apply for a study permit even though you are exempt, you should include a letter of explanation that says why you want one

Reasons to apply for a study permit include being able to:

Keep studying while you renew your permit

  • If you get a study permit before you come to Canada:
    • you can renew your permit and keep studying in Canada while waiting for your new permit because you have implied status.
  • If you don’t have a study permit: you can apply for a study permit from inside Canada, but you can’t start your program until you get the permit.

You can only apply for a study permit within Canada if you’re:

  • A minor
  • an exchange or visiting student
  • a student who has completed a short-term course or study program, which is a condition for being accepted at a DLI
  • someone who holds a temporary resident permit (TRP) valid for at least 6 months, or their family member
  • spouse of someone in Canada (Work Permit)
  • have applied for PR, if eligible.
  • Family members of athletes, media reps, clergy, military etc. 

Apply for a study permit at the port of entry (POE)

You can apply for a study permit when you enter Canada, if you’re a:

  • citizen of the U.S., permanent resident of the U.S., person who has lawfully been admitted to the U.S. for permanent residence
  • resident of Greenland
  • resident of Saint-Pierre and Miquelon

When a study permit is issued

FOREIGN NATIONAL  has been accepted to undertake a program of study that is more than 6 months in duration at a DLI in Canada. 

FOREIGN NATIONAL  demonstrate that they are actively pursuing studies or they risk being removed from Canada 

The DLI is required to report to International Students continue enrollment and academic status to IRCC.

  • DLI must meet minimum IRCC standard
  • Issued a DLI number and designated as a DLI
  • IRCC website shows updates on DLI

 All primary and secondary schools in Canada are DLI automatically; applicants for these school do not require a DLI number on their application, but they do need a letter of acceptance

If you need to take some courses before you are accepted into your program (conditional acceptance), Schools/colleges will only issue your study permit for the length of those courses. Once you are accepted into the main program, you will need to apply to extend your stay as a student

VISITING STUDENT

A visiting student is a student enrolled in their home (foreign) institution, who attends a host Canadian institute, attends for a limited period of time, to transfer the credits earned at home institute. A Visiting Student is not admitted to diploma or degree and pays fee to the host institution. 

EXCHANGE STUDENT

An exchange student does not require Study Permit if program is less than six months but will need if more than 6 months; is not eligible to work off campus. Fee is covered by exchange agreement b/w host and home institute.

The letter of acceptance is a key document: a letter from the institution confirming enrollment that must be included in the application for a study permit. The following items, although not mandatory, should be included in the letter to increase the application’s chances of approval:

Letter of acceptance must include:

  • The full name, dob, full address of student
  • The course of study for which he is accepted
  • Institute’s name + official contact
  • DLI number
  • Telephone, fax, website, and email of institute
  • Type of school-Primary, secondary, publicly funded etc.
  • The field or program of study, level, year of study in which student was accepted
  • Course beginning date
  • The last date on which a student may register for a selected course
  • The academic year of study that student will be entering
  • Full time or part time?
  • Tuition fee
  • Scholarship and other financial aid (if any)
  • LOA expiry date
  • Any conditions 
  • For Quebec, CAQ
  • When applicable, licensing info for private institution, usually confirmed through letterhead.

Study permit exemptions (different page under study permit)

Did you know there are some who are study permit exempt?

That includes:

  • Family members and members of diplomats or accredited representatives.
  • Members of Armed Forces of a country designated for the purposes of the Visiting Forces Act, if intend to study less than 6 months.
  • Any Temporary Resident if studying less than 6 months.
  • Registered Indians.

STUDY PERMIT EXTENSIONS 

In order to extend your study permit you must meet these requirements:

The renewal must be made before current study permit expires-at least 30 days before this expiry date.

  • FOREIGN NATIONAL  has complied with all conditions imposed at the time of entry to Canada. 
  • Must be in compliance with the eligibility criteria of STUDY PERMIT.

A Student is allowed to continue his study if the following conditions are met:

  • Application for renewal was made before expiry of current STUDY PERMIT 
  • student has remained in Canada since the expiry of his STUDY PERMIT and has complied with all requirements..

Study permit restrictions

WORK FOR FOREIGN STUDENTS

Foreign students may work while pursuing post secondary education in Canada in certain circumstances.

Working on campus- Work Permit not required.

Working off campus, enrolled in post-graduate studies, or a co-op program Work Permit required

PGWP-POST GTADUATE WORK PERMIT

Who can apply PGWP?

  • Foreign nationals with valid Study Permit, who are about to graduate, and this means they are one step closer to PR
  • Under PGWP – Open Work Permit, work for any employer for a specific period of time.
  • No LMIA is needed.

A student is not eligible if: 

  • Study program was less than 8 months
  • Has been previously issued a PGWP 
  • Received funding from Global Affairs Canada.
  • Students participated in government of Canada Awards Program funded by GAC or other organizations program such as Chile Scholars, American States etc.
  • Obtained Equal Opportunity Scholarship
  • Did distance learning program

A student must meet the following criteria:

  • Continuous full-time study in Canada at a Post-Secondary institute 
  •  graduated from a program at least 8 months duration
  • Still in possession of a Valid Study Permit
  • Written notice from institution that he is eligible to obtain a degree, diploma or certificate
  • Must apply within 90 days of receiving written confirmation from institution indicating that the academic program was successfully complete (transcript or notice of graduation)

Validity of PGWP

Once granted, a PGWP may be valid for a period of time not exceeding the period during which the graduating student studied at a Canadian post secondary institution and may not exceed 3 years.

Once the Work Permit expires, student may apply for an LMIA to maintain Work Permit status.

Depending on where you live, you may be able to get your study permit faster through the Student Direct Stream (SDS).

We try to process most SDS applications within 20 calendar days. However, some applications may take longer.

  • give your biometrics as soon as possible
  • meet all the eligibility requirements

A study permit is not a visa and does not, by itself, allow you to travel to or enter Canada. You may also need a visitor visa or an electronic travel authorization (eTA). If you do, we’ll issue your visitor visa or eTA with your study permit.
